HUNTSVILLE, AL, February 7, 2013 —Madison County Democrats appealed to their elected officials to stop ignoring the Supremacy Clause, which provides that the Constitution and the Laws of the United States … shall be the supreme Law of the Land. It means that the federal government, in exercising any of the powers enumerated in the Constitution, must prevail over any conflicting or inconsistent state exercise of power.
“In Montgomery yesterday, I actually saw levelheaded statesmanship come from Sen. Arthur Orr, who introduced a bill that would allow early graduating high school students a college scholarship,” said Clete Wetli, chair of the Madison County Democratic Party. “But sadly, Paul Sanford and Shadrack McGill decided to blow the old rusty dog whistle of nullification with their unconstitutional gun legislation, ignoring the Supremacy Clause,” Wetli added.
“Surely, Sanford and McGill are familiar with the Supremacy Clause and know that these types of laws have been repeatedly rejected by the Supreme Court. Do they believe, honestly, that the people of Alabama want to see their tax dollars spent on paying lawyers to defend bogus laws that have already been deemed unconstitutional?
Wetli refers to laws enacted during the 2012 Legislative session that were struck down in multiple courts of law, particularly the Immigration legislation, culminating with the US Supreme Court negating the legislation – and the millions of dollars the state spent in defending the legislation.
“People understand that rights have limits: Freedom of Speech does not give you the right to yell “Fire!” in a crowded theater; likewise, the Second Amendment does not give you the right to bazookas, grenade launchers, or high capacity magazines,” Wetli continued. “McGill goes a step further by trying to make those who enforce Federal law into felons. Not only is this legislation absurd, it is disrespectful to the American people who are looking for sensible answers to curb the problem of rampant gun violence. Mr. Sanford and Mr. McGill, no one is coming to take away your guns. But, please, take Arthur Orr’s lead and look for viable solutions to the real problems that people have in Alabama. I realize especially for Mr. McGill who likely thinks his bill is divinely inspired, but frankly doesn’t have a prayer under the law of our land. Please save us the cost, time, and embarrassment.”
